BANGALORE: Infosys faces a lawsuit, and possibly even a class action lawsuit, in the US on grounds of alleged discrimination in favour of South Asians for its job positions in the country.

Brenda Koehler, an IT professional who was interviewed last year for a technical job position inInfosys that eventually went to a Bangladeshi national, has alleged in a suit filed in the US District Court in Eastern Wisconsin that Infosys"has engaged in systematic, company-wide discrimination against individuals based upon their national origin."

The lawsuit says, "Specifically , Infosys has discriminated against individuals who are not of South Asian (including but not necessarily limited to India, NepalBangladesh) descent. Infosys discriminates against these individuals through disparate treatment in hiring and disparate impact in hiring in violation of Title VII of the Civil Rights Act of 1964, as amended by the Civil Rights Act of 1991."

Koehler is also seeking class action status for what she calls "thousands" of Americans not of South Asian descent who were denied jobs at Infosys since January 1, 2009. The suit notes that 90% of the company's 15,000 employees in the US are of South Asian descent.

Infosys responded saying the company was an equal opportunity employer. "We categorically deny Ms Koehler's claims. We look forward to addressing this matter in court, not in public venues where facts can become mixed with rumour, opinion and speculation. It is important to understand that no proof of class action suitability has been presented and no court has ruled that the case is appropriate for class action treatment," Infosys said.
